Acceptance of terms
By texting Calio's SMS number, completing the onboarding process, accessing your dashboard at textcalio.com, or otherwise using any TextCalio service, you agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, do not use our services. These Terms constitute a legally binding agreement between you and TextCalio Inc. ("TextCalio", "we", "us", or "our").
We reserve the right to update these Terms at any time. Continued use of Calio after changes are posted constitutes acceptance of the revised Terms.
Description of service
Calio is an AI-powered nutrition tracking service that allows users to log food intake, track calories and macronutrients, monitor weight trends, and receive personalized nutrition targets — all via SMS text messaging and a web dashboard.
The service includes:
- AI-powered food and calorie estimation via text descriptions and photos
- Personalized daily calorie and macro targets based on user-provided body statistics
- A personal web dashboard showing daily logs, progress charts, and weekly trends
- Daily SMS nutrition summaries
- Weight tracking with trend visualization
- Nutrition label scanning via photo
We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice to active users.
Eligibility
You must be at least 16 years of age to use Calio. By using the service, you represent and warrant that you meet this age requirement.
You must have a valid mobile phone number capable of sending and receiving SMS messages. Standard carrier message and data rates may apply based on your mobile plan.
Calio is currently available to users with Canadian and US phone numbers. Availability may be expanded over time.
Accounts and access
Your Calio account is identified by your phone number. You are responsible for all activity associated with your phone number and account.
Your personal dashboard is accessible via a unique URL containing a private token. Do not share this URL with others, as it provides access to your personal nutrition data.
You are responsible for maintaining the security of your phone number and dashboard URL. TextCalio is not liable for any loss or damage arising from unauthorized access to your account.
To delete your account and all associated data, text "delete account" to Calio and confirm when prompted. Account deletion is permanent and irreversible.
Acceptable use
You agree to use Calio only for its intended purpose of personal nutrition tracking. You agree not to:
- Attempt to reverse engineer, decompile, or access the underlying code or systems of Calio
- Send automated, scripted, or bot-generated messages to Calio's SMS number
- Attempt to overload, attack, or disrupt the service
- Use the service to collect information about other users
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Use the service for any illegal purpose or in violation of any applicable law
- Attempt to bypass any rate limiting, security measures, or access controls
Violations of this section may result in immediate termination of your account without notice or refund.
Health and nutrition disclaimer
Important: Calio is a general nutrition tracking tool and is not a substitute for professional medical or dietary advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider before making significant changes to your diet.
The calorie and macro targets provided by Calio are calculated using the Mifflin-St Jeor equation based on information you provide. These are estimates and may not be accurate for all individuals, including those with medical conditions, metabolic disorders, eating disorders, or other health considerations.
TextCalio makes no medical claims and does not endorse any specific diet, eating pattern, or health approach. Nutrition estimates provided by Calio's AI are approximations and should not be relied upon as precise measurements for medical or clinical purposes.
If you have a medical condition, are pregnant or breastfeeding, have a history of disordered eating, or have specific dietary needs, consult a qualified healthcare professional before using Calio.
TextCalio expressly disclaims all liability for any health outcomes related to use of the service.
AI-generated content
Calio uses artificial intelligence — specifically OpenAI's language and vision models — to estimate nutrition information, respond to messages, and analyze food photos and nutrition labels.
AI-generated nutrition estimates are approximations. They may be inaccurate, particularly for:
- Home-cooked meals with multiple ingredients
- Foods with variable preparation methods
- Restaurant meals at unfamiliar establishments
- Obscure or regional foods with limited training data
We continuously work to improve accuracy but cannot guarantee that any specific calorie or macro estimate is correct. You should use Calio's estimates as helpful approximations, not precise measurements.
Calio is an AI assistant, not a human. If you ask Calio directly, it will tell you it is an AI. Do not share sensitive personal, financial, or medical information with Calio beyond what is necessary for nutrition tracking.
Payments and subscriptions
Certain features of Calio may require a paid subscription. Subscription details, pricing, and billing terms will be presented clearly at the time of purchase.
Free trial
Where offered, free trials automatically convert to paid subscriptions at the end of the trial period unless cancelled beforehand. You will be notified before your trial ends.
Cancellation and refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will retain access to paid features through the end of the period you have paid for.
Refunds are considered on a case-by-case basis. Contact support@textcalio.com within 7 days of a charge if you believe you were billed in error.
Price changes
We may change subscription pricing with at least 30 days notice to active subscribers. If you disagree with a price change, you may cancel before the change takes effect.
Intellectual property
The Calio service, including its design, code, prompts, algorithms, branding, and content, is owned by TextCalio Inc. and protected by applicable intellectual property laws.
You retain ownership of any personal data you provide to Calio (your food logs, weight entries, and body statistics). By using the service, you grant TextCalio a limited license to process and use your data solely to provide the service to you.
You may not reproduce, distribute, or create derivative works from any TextCalio intellectual property without express written permission.
Termination
You may terminate your account at any time by texting "delete account" to Calio and confirming the deletion.
TextCalio reserves the right to suspend or terminate your access to the service at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if continued service creates legal or operational risk.
Upon termination, your right to use the service ends immediately. If you initiated termination, your data will be deleted in accordance with our Privacy Policy. If we terminated your account for cause, we may retain certain records as required by law or for legitimate business purposes.
Limitation of liability
To the fullest extent permitted by applicable law, TextCalio, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data or inability to access your account
- Any health outcomes resulting from use or reliance on Calio's nutrition estimates
- Inaccurate calorie or macro estimates
- Service interruptions or downtime
- Unauthorized access to your account or data
In no event shall TextCalio's total liability to you exceed the amount you have paid to TextCalio in the twelve months preceding the claim, or CAD $100, whichever is greater.
Some jurisdictions do not allow limitations on implied warranties or liability, so some of the above limitations may not apply to you.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
Governing law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of Calio shall be resolved through binding arbitration in Toronto, Ontario, Canada, except where prohibited by law. You waive any right to a jury trial or to participate in a class action lawsuit.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
